TERMS OF SERVICE

1. General Provisions
1.1. These Terms and Conditions of Sale apply to the purchase of goods and services from the online store located at www.colouredconfidence.com (hereinafter referred to as the “Online Store”). The owner and operator of the Online Store is Helju OÜ (registry code 14866507). Individuals who make purchases from the Online Store are hereinafter referred to as the “Client.”

1.2. In addition to these terms, the relationship between the Client and the Online Store is governed by the applicable laws of the Republic of Estonia, including the Law of Obligations Act, Consumer Protection Act, and other relevant legal acts.

1.3. The Online Store reserves the right to amend these Terms and Conditions of Sale as well as the conditions related to its products at any time. Such changes will be reflected on the website www.colouredconfidence.com/terms-of-service.

1.4. Products sold in the Online Store are protected by copyright laws. The products are intended for the personal use of the Client. Reproduction, summarization, copying, referencing, modification, distribution, or making the products or associated materials available to third parties is strictly prohibited. Clients who breach this prohibition must pay a one-time fee equal to the product price for each person to whom the product materials have been partially or fully disclosed. This obligation is indefinite and does not end with the termination of the product purchase agreement.

2. Price Information and Order Placement
2.1. Product descriptions and prices are provided in the Online Store. Prices are listed in euros (EUR).

2.2. To purchase a product, the Client must select the desired product or service (hereinafter referred to as the “Product”), fill in the required data fields on the website, and choose a suitable payment method.

2.3. Payments are processed by Maksekeskus AS. Payments are made outside the Online Store in a secure environment—via the secure environment of the respective bank when paying through a bank link, or via the secure environment of Maksekeskus AS when paying by credit card. The Online Store does not have access to the Client’s bank or credit card information. The agreement is considered effective once the payment amount has been received in the Online Store’s bank account.

The owner of the Online Store is the data controller for personal data and transmits only the information necessary for payment processing to the authorized processor, Maksekeskus AS.

2.4. Discount codes and gift card codes may be applied in the Online Store. Discount codes are unique and issued during promotional campaigns, either for all buyers or specific buyers. Gift cards are uniquely generated codes and personally sent to the chosen recipient. To use a discount or gift card code, enter it in the “Coupon Code” field during checkout and click “Apply Coupon.” The discount will then be applied to the cart total.

2.5. Verify the accuracy of your provided information, cart contents, and total cost before confirming the purchase by clicking the “Place Order” button.

2.6. Orders are processed automatically upon receipt of payment and confirmation of the order by clicking the “Return to Merchant” button. An order confirmation will be sent to the Client’s email address entered during the purchase, usually within a few minutes.

3. Digital Products
3.1. Certain products, including colour palettes, digital analysis and gift cards are available exclusively online via the Online Store’s dedicated client environment at www.colouredconfidence.com/login (hereinafter referred to as the “Client Portal”).

3.2. Clients must have the technical capability to view and use the materials, including access to a computer or smart device with a sufficiently fast internet connection and the ability to open .pdf or Google Drive files. The Online Store is not responsible for issues or obstacles arising from the Client’s inadequate technical equipment or internet connection.

3.3. Clients have indefinite access to the Client Portal and purchased products, provided the Online Store continues to operate and offer these products. If the Online Store ceases operations or discontinues a product, the Client will retain access for at least 30 days.

3.4. The Online Store reserves the right to make changes to materials in the Client Portal but is not obligated to update them.

3.5. The Client understands and accepts that the Online Store does not guarantee specific outcomes or timelines, as results depend largely on the Client’s expectations, diligence in reviewing the materials, methods of application, and consistency.

3.6. The Online Store may unilaterally restrict a Client’s access to all products or the Client Portal if there is justified suspicion of a breach of the Terms and Conditions, such as unauthorized sharing of login credentials or materials with third parties.

4. Right of Withdrawal
4.1. Pursuant to Section 53(4) of the Law of Obligations Act, the 14-day right of return does not apply to Online Store products.

5. Complaints and Dispute Resolution
5.1. The Online Store is responsible for ensuring that products conform to the agreed terms and do not have defects. Clients must prove that the product does not meet the agreed terms.

5.2. In the case of a defective product, the Client must immediately cease its use and submit a complaint to the Online Store. Complaints must be sent via email to kadri@colouredconfidence.com and include the Client’s name, email address used for the purchase, order confirmation, and a detailed description of the defect.

5.3. The Online Store will respond to the Client within 5 business days of receiving the complaint.

5.4. The Online Store is not liable for defects caused by the Client’s improper use of the product.

5.5. If a dispute cannot be resolved through negotiation, the Client may contact the Consumer Disputes Committee to resolve disputes arising from the agreement. Filing a complaint with the committee is free of charge for the Client.
